We’re on a roll with novel excuses. Yesterday we blogged about a guy who said “inner demons” made him do sexually inappropriate stuff. Today, we’ve got Edward Ates of Fort Pierce. He’s accused of killing Paul Duncsak, his son-in-law, in New Jersey. His defense: He’s too fat to commit that crime. He says he wouldn’t have had the energy to climb and descend the staircase where prosecutors say the killer was perched when he shot Duncsak, reports BuffaloNews.com Ates, 62, stands 5 feet 8 and tipped the scales at 285 pounds in 2006. And he’s not exactly a string bean now. At the time of the killing, Duncsak and Ates’ daughter, Stacey, were involved in a bitter custody fight following their divorce. Prosecutors say Ates drove

from Fort Pierce to Duncsak’s $1.1 million home northwest of Manhattan, and shot him — six times — as he came home from work. He was talking to his girlfriend on a cell phone. But at least Ates’s jail stay caused him to do something his old diet couldn’t do — he lost 40 pounds.
