Judge deals blow to tuition suit against state

A Leon County judge has dealt a blow to former Florida Gov. Bob Graham (left) and the Board of Governors charged with overseeing the state university system.

Graham, the Board and several other defendants sued the state final year, asserting the Board has the constitutional capability to set tuition and that the Legislature’s failure to recognize that authority is hindering the universities’ progress.

But the judge just ruled that Graham and the others have

folded to show standing in the case. He did give the parties until Feb. 4 to submit further evidence showing their right to sue.

“It’s safe to say we’re disappointed,” said Board of Governors spokesman Bill Edmonds. “But we’re confident we can show damage has been done and we have standing.”
