Another fight, another lawsuit against Pinellas schools

The father of a Pinellas high school student has filed suit against the school district because his son was allegedly punched in class by a student at Boca Ciega High in 2007. The suit, filed by Stephen Pelo on Nov. 6 in circuit court, says his son Zachary Pelo had an "altercation" in a classroom that involved another student, Kelvin Smarwt. Smarwt, who is listed as a junior running back on Boca Ciega's football team this year, struck Pelo with his fist and caused injuries to

Pelo's head, neck, body and limbs, the suit says. It accuses the district and Smarwt's parents of negligence. The parents are also listed as defendants. The cause of the altercation is unclear from the complaint. Stephen Pelo's attorney, Joshua T. Chilson, said at his client's request he could not comment. The Smarwt family could not be reached for comment. The suit is the fourth filed over violence in Pinellas schools since Sept. 18.
